These Terms & Conditions apply to all quotations, proposals, invoices and services supplied by Alter Ego Media ("we", "our", "us") to the client ("you", "your"). Acceptance of a quotation, payment of a deposit, or commencement of work constitutes acceptance of these Terms & Conditions.
1. Services
Alter Ego Media provides creative and digital services including, but not limited to:
- Logo Design
- Brand Identity
- Graphic Design
- Website Design
- Website Development
- Website Maintenance
- Search Engine Optimisation (SEO)
- Social Media Design
- Marketing Material Design
- Print-Ready Artwork
- Packaging Design
- Signage Design
- Digital Advertising Creative
- Content Creation
- Consulting
2. Quotations
- Quotes remain valid for 30 days unless otherwise stated.
- Quotes include only the services specifically listed.
- Anything not listed is excluded.
- Additional work will be quoted separately.
3. Deposits
Projects commence only after the required deposit has cleared.
- Under $500: 100% upfront.
- $500 – $2,000: 50% deposit, 50% before delivery.
- $2,000 – $8,000: 40% deposit, 30% at concept approval, 30% before delivery.
- Large projects: milestone payments.
4. Payment Terms
- Invoices are due within 7 days unless otherwise stated.
- Late payments may result in: suspension of work, delay in delivery, suspension of website hosting or maintenance (where applicable), and recovery costs.
- Final files will not be supplied until invoices are paid.
- Websites will not be launched until payment has been received.
5. Revisions
- Each package includes the number of revisions specified in your proposal.
- Revisions include reasonable changes to the approved concept.
- Additional revisions are billed at $120 per hour.
- Changing the design direction after concept approval is considered additional work.
6. Scope Changes
Any work outside the agreed scope will be quoted separately. Examples include: additional pages, extra concepts, additional branding, new functionality, copywriting, photography, illustration and animation.
7. Client Responsibilities
The client agrees to:
- Provide required content promptly.
- Review work within reasonable timeframes.
- Provide consolidated feedback.
- Ensure supplied material does not infringe copyright.
- Maintain copies of supplied files.
Failure to provide content may delay the project.
8. Intellectual Property
- All concepts remain the property of Alter Ego Media until paid in full.
- Upon final payment, ownership of final approved deliverables transfers to the client.
- Working files remain the property of Alter Ego Media unless specifically purchased.
- Alter Ego Media may display completed work in portfolios and marketing unless otherwise agreed.
9. Third Party Assets
Projects may use licensed fonts, stock photography, icons, plugins, software and templates.
- These remain subject to their respective licences.
- The client is responsible for maintaining any required ongoing licences unless otherwise agreed.
10. Website Hosting
Unless included:
- Hosting is the client's responsibility.
- Domain registration is the client's responsibility.
- Email hosting is the client's responsibility.
Alter Ego Media can arrange these services at additional cost.
11. Website Maintenance
- Maintenance plans include only services specifically listed.
- Unused monthly support time does not roll over.
- Emergency work outside business hours may incur additional fees.
12. SEO
SEO services are provided using industry best practice. No guarantee is made regarding:
- Google rankings
- Traffic
- Sales
- Leads
Search engine algorithms are outside our control.
13. Print-Ready Artwork
- Alter Ego Media provides design and print-ready artwork only — we do not offer printing services.
- Clients are responsible for arranging their own printing with a printer of their choice.
- Colours displayed on screen may differ from printed products; Alter Ego Media is not responsible for printer variations.
- Clients are responsible for approving artwork before sending to print.
14. Website Testing
- Clients are responsible for reviewing their website before launch.
- Approval constitutes acceptance.
- Post-launch changes outside agreed scope are billable.
15. Delays
If the client delays the project for more than 30 days, Alter Ego Media may:
- Pause the project.
- Requote remaining work.
- Charge recommencement fees.
- Archive project files.
16. Cancellation
- Deposits are non-refundable once work has commenced.
- If the project is cancelled, the client must pay for all completed work.
- Completed milestones remain payable.
- Alter Ego Media retains ownership of unpaid work.
17. Refunds
Due to the custom nature of creative services, refunds are generally not available once work has commenced. Refund requests will be considered only where required by the Australian Consumer Law (ACL). Nothing in these Terms excludes or limits any rights the client has under the ACL.
18. Confidentiality
Both parties agree to keep confidential information private unless disclosure is required by law.
19. Limitation of Liability
To the maximum extent permitted by Australian law, Alter Ego Media shall not be liable for:
- Loss of profits
- Business interruption
- Loss of data
- Indirect or consequential loss
Our total liability is limited to the amount paid for the relevant service. This clause does not exclude liability that cannot legally be excluded under the Australian Consumer Law.
20. Force Majeure
Neither party is liable for delays caused by events beyond reasonable control including: natural disasters, internet outages, government restrictions, power failures, pandemics and cyber incidents.
21. Portfolio Rights
Unless agreed otherwise, Alter Ego Media may display completed work on:
- Website
- Portfolio
- Social media
- Advertising
- Awards submissions
22. Communication
Primary communication will occur via:
- Phone
- Video meetings
- Project management software (if applicable)
Delays in client responses may affect delivery timelines.
23. File Storage
- Project files are retained for 12 months after completion.
- After this period, files may be deleted without notice.
- Clients should securely back up all delivered files.
24. Website Warranty
Minor bugs reported within 30 days of launch will be corrected at no charge where they relate to the agreed scope. The warranty does not cover:
- Third-party plugin issues
- Hosting problems
- Changes made by the client or another developer
- New browser or operating system changes after launch
25. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of the courts of Queensland.
26. Acceptance
Acceptance of any quotation, invoice, proposal, or payment confirms that the client has read and agrees to these Terms & Conditions.
